This agreement represents the complete agreement
and understanding between Airspeed Wireless
Inc., (hereinafter called The Company) and the
customer (hereinafter called Customer) and
supersedes any other written or oral agreement.
Upon notice published on-line via The Company,
The Company may modify these terms and
conditions, amplify them, and/or modify the
prices, as well as discontinue or change the
services offered.
- A completed and signed application form is
required for all access to the Company. The
Company reserves the right to reject any
applications.
- The setup fee is nonrefundable, and must be
included with the application form at time of
processing.
- Wireless equipment that is provided by The
Company, for use of the Customer, remains the
sole property of The Company. Upon termination
of the contract, by either party, this equipment
must be returned to The Company. Failure, on the
part of the Customer, to return the equipment,
to the Company, will result in full market value
of said equipment ($499.00) becoming immediately
due and payable, to The Company, by the
Customer. Failure, on the part of the Customer,
to pay the full market value of said equipment,
to the Company, will result in the outstanding
account being forwarded to the Company’s
Collection Service.
- Users of The Companies system are not allowed
to re-sell access to services accessed via The
Company unless a separate reseller agreement is
signed.
- Users of The Company's system are not allowed
to serve files in any way via The Company unless
a separate agreement is signed. (Acceptable Use
Policy)
- The Company is not responsible for any system
damage, loss of data, loss of business or monies
due to files or data retrieved from The Company.
- Our technicians ensure that your wireless
Internet access and settings are correct and
your computer is connected to the Internet when
they have completed your installation. Any
setting changes or downloads that are executed
by the subscriber, become the subscriber’s
responsibility. Any subsequent service calls
that are required, as a result of any settings
that are changed or downloads that affect the
Internet service, will be charged to the
subscriber. If you are in doubt regarding any
downloads that may affect your service, please
call tech support at 1-866-832-6020 prior to
executing the download to ensure trouble free
uninterrupted Internet access.
- Any equipment purchased by the customer, i.e.
routers, hubs, ethernet converters, computer
software or hardware, is the sole responsibility
of the customer. Any service calls that are
required relating to such equipment will be
charged to the customer.
- The Company reserves the right to
terminate/restrict any access at any time for
any reason. Our sole liability will be the
refund of any unused portion of the monthly
and/or equipment rental fees; The Company makes
no claim as to providing guaranteed
minimum/constant bandwidth and service may vary
subject to Customer usage and network
congestion.
- Because the Internet is a global community
consisting of members from many countries with
varying local laws and customs, it is possible
to access material of questionable content. The
Company is not responsible for this material.
Parents are expected to supervise their
children's use of the internet.
- To terminate your account, we require a
minimum of 30 days prior written notice.
- The Company does all Internet billing in
accordance with its standard billing and payment
policies.
Exclusion of Liability: In no event shall The Company, or its employees,
subsidiaries, agents or servants be liable for
any damages, direct or indirect, consequential
or otherwise, including, without limitation,
system damages, loss of data, loss of monies,
loss of business or damages for loss of business
profits, business interruption, loss of business
information or monies and whether the same arise
in contract or in tort or arise by reason of
anything done or omitted to be done by or on
behalf of the said Company.
